Man arrested for raping blind / visually-handicapped girl

Pilibhit: A 40-year-old man was taken into custody on Sunday on suspicion of raping a 13-year-old girl with vision impairment at a village that is within the boundaries of Barkhera police station. The girl and two of her younger siblings were left at home on Friday as the victim's parents went to a community health center to check on a relative.
The accused, who lived in a nearby village and was a distant relative of the family, came to the house, sent the victims' siblings outside on false pretenses, and sexually assaulted her. Before leaving the scene, the accused further threatened to kill the victim if she told anyone about it.
The following day, the victim told her parents about the experience, and they subsequently submitted a formal report to the police. "A case was registered against the accused on Saturday evening under BNS sections 333 (house-trespass after preparation for hurt, assault, or wrongful restraint), 64 (rape), and 351 (3) (aggravated criminal intimidation including causing death)," the SHO stated. The children were familiar with the accused, who had visited the victim's home two days prior.
"The accused was produced before the remand magistrate and sent to jail under judicial custody," the SHO added.
According to the circle officer, the FIR originally used section 3/4 of the Pocso Act, which deals with penetrative sexual assault. However, it was later amended to include section 5(k) of the POCSO Act, which deals with committing penetrative sexual assault by taking advantage of a child's physical disability, and section 6 of the POCSO Act, which deals with aggravated penetrative sexual assault. "Both these sections were applied specifically for having the provision for a minimum of 20 years' imprisonment, which may extend to life imprisonment," he stated.
