KOLKATA: On Thursday, the Calcutta High Court struck down a Bengal government notification that had created 1,600 supernumerary teaching posts. These positions were established following a cabinet decision in May 2022, which aimed to absorb candidates from the waitlist of the 2016 state-level selection test for physical education and work education teachers in state-run upper primary schools.
The court invalidated the notification, questioning the legitimacy of the decision-making process and ruling that it violated recruitment rules, specifically Rule 8. This rule mandates that candidates should not be recommended for vacancies that have not been officially notified.
The High Court concluded that since the posts had not been announced within the required time frame, they constituted "new" vacancies. As such, the court stated that these positions should have been filled through a fresh recruitment process.
